Can you divorce online in Miami, Florida?

Yes. You can get divorce completely online-with NO court hearing- in Miami, Florida. You ca even get divorced online in Miami if you live outside Miami-Dade County, Florida, if your case satisfies these requirements.

Are online divorces legitimate?

Online divorces are legitimate if they are offered by your local divorce court. Keep in mind that online divorces are about how to do the processing of the divorce itself. For example, there are no court hearings to attend, and all the documentation required is presented electronically. An online divorce still requires that you satisfy all legal requirements for a divorce. Not all divorce courts throughout Florida may be offering this process.

What is the difference between your service for a divorce online and a self-help divorce?

This service is not for a self-help divorce. We do the divorce–we do the paperwork, the electronic filing with the court. There are no court hearings. Instead, everything is done online until we get you the divorce decree.  All you have to do is provide information.

With a self-help divorce, you do your own divorce, you need to visit the Court’s website and follow their current instructions for litigants who will be representing themselves.

What is the difference between your service and the document preparations services online?

Most people who see the “online divorce” advertisements on search engines for $149 or $299, etc., don’t realize that what they are being charged for is filling out the forms, whether done by a person or some online software.

Our service includes unlimited legal advice. We prepare all the documents, advice you as to all the requirements you may need to complete, for example, in divorces with children. We handle the process from beginning to end: from filing the case in court until we get the final judgment of dissolution.

What is the difference between a “simple divorce” and a “Florida simplified divorce?”

A simplified divorce is what the courts call a divorce where:
both persons sign the petition and
both persons go to court on the date of the hearing, and
• is a simple divorce; and
CANNOT be used if there are minor children of the marriage

A simple divorce, on the other hand, is a divorce in which:
•both parties agree to the divorce (and also agree on everything else that needs to be agreed to).
•only one person signs the petition (the other one signs a different paper)
No one needs to go to court (see below).
CAN be used even if the parties have minor children of the marriage

When looking for information on divorce in Florida, most people will come across the term “simplified divorce” and confuse it with a simple divorce in Florida.

Can I get an online divorce in Miami without my spouse’s signature?

Generally, no. The only time you don’t need your spouse’s signature to get a divorce is when you don’t know where your spouse is.–see the next question for an answer to this situation Your spouse does not have to agree to get divorced; your spouse’s signature is required so that you don’t have to serve them with divorce papers, which is what is done in a contested divorce.

But serving a spouse with divorce papers does not necessarily mean your divorce will be contested. Many of my clients who have hired me through this site have had this problem, and we have still been able to do their divorce uncontested.

How can I get a divorce online if my spouse is missing-I don’t know where they are?

If you don’t know where your spouse is and want to get divorced, then you need to do a Florida divorce by publication.

If you do know where your spouse is then you have to get your spouse’s signature to do the divorce as an uncontested divorce–see also the question before this one.

Can you divorce online in 3 weeks?

Yes. But most divorce that qualify for a quick divorce are taking less than three (3) weeks because the work is being done completely electronically. Also, the time is calculated from the date of filing the case, not when you first contact us.

Can I change my divorce from uncontested to contested in Miami?
